Florida Bar Rejection Prompts Legal Heavyweights to Seek Supreme Court Intervention
A coalition of legal advocacy groups and attorneys has formally petitioned the Florida Supreme Court to intervene and order the Florida Bar to conduct a full investigation into alleged unethical conduct by Florida Bar member and current Attorney General of the United States, Pam Bondi. The move comes after the Florida Bar reportedly rejected an initial complaint detailing accusations of professional misconduct that advocates argue threaten the rule of law and the administration of justice.
The petition filed by Democracy Defenders Fund (DDF), Lawyers Defending American Democracy (LDAD), Lawyers for the Rule of Law, and joined by 70 attorneys, law professors, and former judges, seeks to compel the Florida Bar to adhere to its own rules and investigate the allegations against AG Bondi.

The core of the complaint centers on a memorandum issued by Attorney General Bondi on her first day in office, which allegedly sought to compel Department of Justice (DOJ) lawyers to violate their ethical obligations under the guise of “zealous advocacy.” The memorandum reportedly threatened lawyers with discipline and termination for falling short, despite professional conduct rules limiting “zeal” to “lawful and ethical measures.”
The complaint highlights three cases where DOJ lawyers were allegedly terminated or forced to resign due to demands for unethical actions, either by Attorney General Bondi herself or a member of her senior management team.

Ambassador Norm Eisen (ret.), executive chair of Democracy Defenders Fund, emphasized the gravity of the situation, stating, “Since her first day on the job, Pam Bondi has made clear that she plans to use the Department of Justice for political pursuits, and she has done just that. The Florida Bar has a responsibility to hold Bondi – and every lawyer under its purview who is implicated in her conduct – to account for actions that threaten the rule of law and the administration of justice.”
Jamie Conrad, a volunteer with Lawyers Defending American Democracy and a co-author of both the complaint and the petition, underscored the principle of equal accountability: “Attorney General Bondi and her team cannot be allowed to operate the Justice Department free from compliance with the same ethics rules applicable to all other lawyers. The AG frequently states that ‘no one is above the law.’ The Florida Bar needs to demonstrate that this includes her.”

Jon May of Creative Criminal Defense Consultants, who initially submitted the complaint, stressed the unique role of the legal profession in upholding democratic institutions.
“What sets us apart from all the nations of the world is the role that the legal profession plays in preserving our democratic institutions,” May said. “Because we are governed by a set of principles common throughout the United States that require duties of candor to the courts and to the administration of justice, we are the final bulwark against autocratic rule that would seek to undermine the rule of law. The Florida Bar cannot shirk from its responsibility to hold all lawyers accountable to those principles.”
