The 11th U.S. Circuit Court of Appeals has scheduled a hearing for the week of December 16 in Atlanta to hear arguments in a challenge by Florida and three other states to a new federal rule regarding sex-based discrimination in education programs.
The rule, which deals with Title IX, has drawn opposition from Republican-led states across the country, largely because it would extend Title IX regulations to apply to discrimination based on gender identity.

Florida, Alabama, Georgia, and South Carolina filed an appeal in July after a U.S. District Judge rejected their request for a preliminary injunction against the rule.
A panel of the appeals court in August granted a request by the states to block the rule while the appeal plays out. However, this move did not resolve the underlying questions in the states’ appeal of the district judge’s decision.

The hearing in December will provide an opportunity for the states to present their arguments against the rule and for the court to consider the complex legal issues involved.
