Biden Maneuvering Toward A Backdoor Way To Maintain A Federal Database Of Gun Owners

Liberals have long harbored a dream of implementing a federal database of gun owners.

For example, 55 years ago, Pete Shields, chairman of the National Council to Control Handguns, told the New Yorker in an interview that getting all handguns registered in some form was the bridge between slowing sales of such firearms and then outlawing their possession.

A decade after that comment, President Ronald Reagan slammed the door on that idea.

Reagan signed the Firearms Owners’ Protection Act in 1986. The law contained a clause that said no rule or regulation “may require that records required to be maintained under this chapter or any portion of the contents of such records, be recorded at or transferred to a facility owned, managed, or controlled by the United States or any State or any political subdivision thereof, nor that any system of registration of firearms, firearms owners, or firearms transactions or dispositions be established.”

Yet the Biden administration has once again found a way to skirt federal law to pursue a left-wing, and likely unconstitutional, policy.

The conservative Washington Free Beacon recently reported that in the past year, the Biden administration has “stockpiled the records of more than 54 million U.S. gun owners and is poised to drastically alter gun regulations to ensure that information on Americans who own firearms ultimately ends up in the federal government’s hands.”

The source for that claim was internal records compiled by the Bureau of Alcohol, Tobacco, Firearms, and Explosives.

The Free Beacon reported that when a federally licensed firearms dealer goes out of business its sales records become the property of the federal government, which then warehouses them in a West Virginia facility.

“This practice allows the federal government to stockpile scores of gun records and has drawn outrage from gun advocacy groups that say the government is using this information to create a national database of gun owners — which has long been prohibited under U.S. law,” the Free Beacon reported.

As the pandemic raged during the last fiscal year, which ended Sept. 30, the feds amassed 54.7 million such records.

“Gun activists described this figure as worryingly high and said it contributes to fears that the Biden administration is trying to keep track of all Americans who own firearms, in violation of federal statutes,” the Free Beacon continued.

“The procurement of these records by the ATF comes as the Biden administration moves to alter current laws to ensure that gun records are stored in perpetuity.”

Currently, firearms dealers can destroy their records after 20 years under federal law.

Aidan Johnston, director of federal affairs for the pro-Second Amendment Gun Owners of America, told the Free Beacon, “As if the addition of over 50 million records to an ATF gun registry wasn’t unconstitutional or illegal enough, the Biden administration’s misuse of ‘out-of-business’ records doesn’t end there. Instead of maintaining the right of [licensed firearm dealers] to destroy Firearm Transaction Records after 20 years, buried within Biden’s proposed regulations is a provision that would mean every single Firearm Transaction Record going forward would eventually be sent to ATF’s registry in West Virginia.”

That would happen through new regulations on gun accessories or different types of weapons.

An ATF spokesman told the Free Beacon that the shipping of those records to the agency’s facility did not “constitute an initiation or continuation of any federal gun registry.”

But remember: that spokesman works for a radical president who claimed he would not impose a vaccine mandate (one has been ordered), raise taxes on people making less than $400,000 (6 million people making less than a quarter of that amount face higher taxes), shut down “the virus” (that has killed nearly 400,000 people since he took office) and not leave any Americans behind in Afghanistan {although 14,000 U.S. green-card holders are still there).
