Disability Rights Group Sues Florida DCF Over Baker Act Data

Disability Rights Florida has filed a lawsuit against the Florida Department of Children and Families (DCF), alleging the agency’s failure to collect and report data on the use of the Baker Act.

The Baker Act allows for the involuntary commitment of individuals with mental illness.

The lawsuit contends that DCF has not complied with a 2007 law requiring the agency to publish reports and data on Baker Act usage.

The organization argues that the lack of data hinders its ability to monitor psychiatric hospitals and advocate for the rights of individuals with mental illness.

The lawsuit seeks a court order compelling DCF to collect and report the necessary data.
