The Department of Justice (DOJ) has filed a lawsuit to block the new congressional district boundaries approved by California voters last week, injecting the federal government directly into a high-stakes court battle that could determine control of the U.S. House in the 2026 midterm elections.

The complaint, filed in California federal court, targets the newly approved map, known as Proposition 50, which was pushed by Democratic Governor Gavin Newsom. The move is viewed as a direct response to a similar Republican-led redistricting effort in Texas. The legal action sets the stage for a major political confrontation between the current administration and Governor Newsom, who is seen as a likely 2028 presidential contender.

Attorney General Pam Bondi confirmed the lawsuit and issued a sharp critique of the state’s actions.

“California’s redistricting scheme is a brazen power grab that tramples on civil rights and mocks the democratic process,” Attorney General Pam Bondi said in an emailed statement. “Governor Newsom’s attempt to entrench one-party rule and silence millions of Californians will not stand.”

Newsom’s spokesperson, Brandon Richards, countered to the AP with equal fervor, stating: “These losers lost at the ballot box and soon they will also lose in court.”

The lawsuit accuses the state of racial gerrymandering in violation of the Constitution, specifically alleging the map uses race as a factor to illegally favor Hispanic voters. The DOJ has joined an existing case brought by the California Republican Party and seeks to prohibit California from using the new map in any future elections.

The core political implications are clear. Democrats currently hold 214 seats in the House, while Republicans hold 219. Democrats need to gain only a handful of seats to take control of the chamber. California’s Proposition 50 was designed with that goal in mind, giving Democrats a strong shot at winning five seats currently held by Republicans.

The lawsuit states: “Race cannot be used as a proxy to advance political interests, but that is precisely what the California General Assembly did with Proposition 50—the recent ballot initiative that junked California’s pre-existing electoral map in favor of a rush-job rejiggering of California’s congressional district lines.”

National Context and Controversy

The legal action against heavily Democratic California is the first time the Justice Department has sued over the mid-decade House map revisions sweeping the country, all drawn to maximize partisan advantage.

Critics have noted that the Justice Department has not filed similar federal legal action against Republican-led states—including Texas, Missouri, and North Carolina—which also revamped district lines following calls for new maps. Civil rights advocates have argued that the new boundaries in both Texas and Missouri illegally disadvantage minority communities.

The high-profile political nature of the California measure was underscored by its supporters and opponents, including former President Barack Obama, who appeared in ads supporting it, and former Republican Governor Arnold Schwarzenegger, who opposed it.
