“F You Up”: Florida Man Arrested After Violent Late-Night Break-In Attempt

A 63-year-old Florida man faces an attempted burglary charge after police say he tried to break into a home late Monday night in New Smyrna Beach.

Kevin John Moss was arrested following an incident reported around 11:30 p.m., according to a probable cause arrest affidavit. The homeowner, Judy Lewis, told officers she was sitting in her living room when she heard someone attempting to open her front door.

When Lewis asked her son to investigate, he looked through the window and observed a shirtless man, later identified by police as Moss. According to the affidavit, Moss made death threats, gestured with a “finger gun,” and yelled “boom, boom, boom.” Ring camera footage from the residence also recorded the suspect shouting verbal threats at the occupants.

Authorities stated that Moss then walked to the back of the residence and tried to push through a sliding glass door.

“I just want to say that my son, my nephew, my dog and I are OK this morning. Very thankful for that. But we had a harrowing night last night at my home. I’m posting this as a PSA to everyone, but also so I don’t have to keep repeating the story,” said Lewis in a social media post.

“He got very aggressive. The boys started yelling at him to get the F out and that we were calling the police while the guy was trying as hard as he could to get in,” said Lewis. “My 20 yr old son was holding the deadbolt and had his body up against the door, just in case.”

Police report that Moss also attempted to open a kitchen door before leaving the immediate area.

“He went through our fence gate and came around the back of the house. While we didn’t know if he left or not, the three of us stood in my kitchen, staring at my kitchen door that leads out to our back patio, wondering if he was coming,” said Lewis. “And then we heard the bang against the door and then violently trying to open my door. My son stood there with a butcher knife in a stance ready for the guy to come in. The guy was yelling how he was gonna kill us and “ I’m going to F you up”.

Law enforcement officials noted that there is no known motive for the home’s targeting.

Responding officers located Moss nearby and took him into custody. He was booked into the Volusia County Jail on an attempted burglary charge involving an occupied dwelling. Moss has since posted a $10,000 bond, and his next court date is scheduled for August 18.
