The U.S. Department of Education’s Office for Civil Rights (OCR) has officially launched an investigation into Smith College to determine if the institution is in violation of federal law.
The probe focuses on the college’s policy of admitting biological men and providing them access to spaces traditionally reserved for women, including dormitories, bathrooms, locker rooms, and athletic teams.
Smith College, recognized as one of the largest all-women’s colleges in the country, is under scrutiny regarding its compliance with Title IX of the Education Amendments of 1972.
While Title IX generally prohibits sex-based discrimination in federally funded programs, it contains a specific exception that allows certain colleges to maintain single-sex student bodies. The current investigation hinges on whether this exception applies strictly to biological sex or if it can be extended to include subjective gender identity.

Under the federal guidelines being cited by the OCR, a single-sex institution may lose its protected status if it enrolls students of the opposite biological sex, regardless of how those students identify.
The investigation seeks to address whether the inclusion of biological males fundamentally alters the nature of an all-women’s environment, which is legally intended to provide specific privacy and athletic opportunities for female students.
Assistant Secretary for Civil Rights Kimberly Richey emphasized the administration’s stance on the matter, noting that the policy shift at the college level triggers significant legal questions.
“An all-women’s college loses all meaning if it is admitting biological males,” Richey stated. “Allowing biological males into spaces designed for women raises serious concerns about privacy, fairness, and compliance under federal law. The Trump Administration will continue to uphold the law and fight to restore common sense.”

The outcome of this investigation could have broad implications for how single-sex institutions across the United States navigate admissions and campus facilities.
For now, the OCR will review Smith College’s practices to ensure they align with the statutory requirements of Title IX, which prohibits discrimination while maintaining the integrity of sex-segregated programs and spaces.
