Feds Level New Terrorism Charges Against Virginia Man In D.C. Pipe Bomb Case

Federal prosecutors on Tuesday brought heavy new charges against Brian Cole Jr., the Virginia resident accused of planting pipe bombs at the Republican and Democratic national headquarters on January 5, 2021.

Though Cole has been in custody since his arrest in December, a fresh grand jury indictment has now added counts of armed terrorism and the use of weapons of mass destruction to his case.

The legal stakes have shifted significantly with this move. A conviction on the weapons of mass destruction charge alone could result in a life sentence. These new allegations supplement his initial charges involving the transport and attempted use of explosives.

The pipe bombs, which were found but did not detonate, sparked a nearly five-year investigation. Following his arrest, prosecutors say Cole told investigators that “something just snapped” in his mind, leading him to target both political parties.

Federal officials say they linked Cole to the scene through a combination of phone records, bank data, and vehicle information, alleging he continued to purchase bomb-making materials even after the D.C. incident.

Cole’s defense attorney, Mario Williams, pushed back against the recent escalation of the case.

“For no logical reason at all, the government has gone from identifying the alleged device as an explosive to now referring to that same device as a ‘weapon of mass destruction,’ knowing experts have said this device would not have detonated,” Williams told the Tampa Free Press in a statement. He noted that the shift in terminology raises “serious concerns” regarding the prosecution’s motives.

“The government now wants Brian Cole Jr. (a Black man) to go down in history as the only alleged, accused January 6-related individual to serve not only a jail sentence, but to serve the rest of his life in prison,” Williams said.

The Trump administration credited the breakthrough to a more efficient use of data compiled during the previous term, finally ending the multi-year manhunt.

The case remains complicated by the recent blanket pardon issued for most pro-Trump protesters involved in the January 6th Capitol riot.

In March, Cole’s legal team argued that this pardon should cover his alleged actions and asked the court to dismiss the charges. However, Cole remains held in jail as the legal proceedings move forward under the new indictment.
