A 37-year-old high school teacher in Florida is behind bars this week after authorities uncovered evidence of a sexual relationship between her and a 17-year-old student. Heather Mashburn-Smith, an educator at Port Charlotte High School, was taken into custody Wednesday following a tip that led investigators to the campus.
According to the Charlotte County Sheriff’s Office, the allegations involve at least two separate sexual encounters that took place on school grounds within the last month.
While the legal age of consent in Florida is 18, the charges against Mashburn-Smith were elevated to a first-degree felony because of her professional position of authority over the minor.
Detectives noted that Mashburn-Smith provided a full confession after being read her Miranda rights. In a mugshot released by the department, the teacher appeared visibly distraught.

Following the arrest, Charlotte County Public Schools Superintendent Mark Vianello confirmed that Mashburn-Smith has been placed on administrative leave while the district pursues “full accountability” for the breach of protocol.
Sheriff Bill Prummell expressed sharp criticism regarding the breach of trust inherent in the case.
“What this woman has done is not just unlawful, it is damaging to the students and staff around her,” Prummell stated. He emphasized that the role of a teacher is rooted in mentorship and guidance, and that this specific interaction “preyed on one of the people she was entrusted to protect.”
The school district has reiterated its commitment to student safety as the legal process moves forward. Vianello described the situation as a “direct violation” of the duties owed to the families of Port Charlotte.
Mashburn-Smith currently faces charges of unlawful activity with a minor as law enforcement continues their investigation into the scope of the relationship.
