A federal court has postponed a detention hearing for a former CIA official arrested last week after federal agents allegedly discovered $40 million in gold bars at his home during a background fraud investigation.
David J. Rush remains in custody following his arrest by FBI agents. According to court records and sources familiar with the matter, federal authorities were initially investigating whether Rush had lied about his educational and military credentials when they uncovered the massive cache of gold.
In a joint statement, the FBI and CIA confirmed that Rush was taken into custody following an internal referral from the CIA, which flagged “potential violations of law.” Both federal agencies noted that they are continuing to investigate the case.
Rush was scheduled for a detention hearing on May 29, 2026, in the U.S. District Court for the Eastern District of Virginia. However, federal prosecutors and defense attorney Jessica N. Carmichael filed a joint motion on May 27 to push the hearing back to June 5, 2026, at 10:00 a.m.
According to the official court filing, the one-week postponement is necessary “to allow time for both the defense and the prosecution to gather and evaluate additional information to aid the Court in its determination on whether David Rush should be released pending trial.”
Rush will remain jailed in Alexandria division custody until the June 5 hearing, where a judge will decide if he can be released on bond or must remain detained leading up to his trial.
