Former Special Counsel Jack Smith has been called to testify before the House Judiciary Committee, as Chairman Rep. Jim Jordan (R-Ohio) demands answers regarding the handling of the now-dismissed prosecutions against President Donald Trump.
In a scathing letter, Rep. Jordan asserted that Smith is “ultimately responsible for the prosecutorial misconduct and constitutional abuses” that occurred during his tenure. Smith led two high-profile federal prosecutions against President Trump, which were ultimately dismissed after Trump won the 2024 presidential election.
The committee’s letter, made public today, outlined a series of alleged abuses under Smith’s watch, including efforts to “silence President Trump by restricting his public statements about the case,” an “unnecessary and abusive raid” of his residence, attempts to “improperly pressure defense counsel,” and the alleged manipulation of “key evidence in the investigation.”

“These actions undermined the integrity of the criminal justice system and violated the core responsibility of federal prosecutors to do justice,” Jordan wrote.
Demand for Testimony and Documents
Rep. Jordan argued that Smith’s testimony “is necessary to understand the full extent to which the Biden-Harris Justice Department weaponized federal law enforcement.” The chairman urged Smith to contact the committee to schedule a transcribed interview by October 28, 2025.
In addition to his testimony, the committee is demanding a comprehensive collection of documents and communications related to Smith’s work as Special Counsel, as well as documents concerning his appointment to the role.
The call for Smith’s testimony follows the refusal of two of his top prosecutors, Jay Bratt and Thomas Windom, to answer committee questions by invoking privileges and the Fifth Amendment during their respective interviews.
‘Arctic Frost’ Investigation Under Scrutiny
The letter also highlighted deeply concerning details that have recently emerged from the “Arctic Frost” investigation, a probe led by Smith’s office.
According to documents released on October 7 by the FBI, Smith’s team obtained phone records of eight Republican senators and Republican Tennessee Rep. Bill Hagerty as part of the investigation.

Furthermore, earlier records released by Republican Sen. Chuck Grassley (R-Iowa) revealed that subpoenas were issued to dozens of conservative organizations, including Turning Point USA and the Republican Attorneys General Association.
During his committee interview, prosecutor Thomas Windom reportedly declined to answer “how many other members of Congress were investigated as part of the Arctic Frost investigation and Jack Smith investigation,” according to Jordan’s letter.
Ethics Probe Also Ongoing
Smith is already facing scrutiny from an internal federal watchdog. Republican Arkansas Sen. Tom Cotton confirmed in August that the former special counsel is the subject of an ethics investigation by the Office of Special Counsel (OSC). The probe is centered on whether Smith violated the Hatch Act, a federal law that restricts political activities by most federal employees.
