U.S. Immigration and Customs Enforcement (ICE) has lodged an arrest detainer against an illegal alien from Mexico, Sergio Noe de Nova Duarte, following his arrest for a brutal attack on a woman jogging in Bob Woodruff Park in Plano, Texas.

De Nova Duarte was charged by the Plano Police Department on November 13 with aggravated kidnapping and bodily injury for allegedly attacking the innocent woman with a hammer. The ICE detainer was lodged with the Collin County Jail to prevent his release back into American communities while he faces criminal charges.

The incident has drawn sharp criticism regarding De Nova Duarte’s immigration status and prior interactions with law enforcement. ICE officials noted that the suspect possesses a “lengthy rap sheet,” including previous arrests in 2024 for burglary and larceny.

According to ICE, following his 2024 arrests, the agency apprehended De Nova Duarte, but the “Biden administration released him into the country with a notice to appear before an immigration judge in 2026.”

Assistant Secretary Tricia McLaughlin issued a strong statement regarding the case.

“This criminal illegal alien should have never been loose in our communities to attack this woman jogging in a park with a hammer,” said Assistant Secretary Tricia McLaughlin. “Following this illegal alien’s arrest in 2024, the Biden administration released this criminal illegal alien back into our communities. Under President Trump and Secretary Noem, ICE lodged an arrest detainer to ensure this criminal illegal alien is NEVER able to prey on innocent women in our country again.”

Records indicate that Sergio Noe de Nova Duarte initially entered the U.S. on a B2 tourist visa in 2016. The visa conditions required him to depart the country by September 17, 2016, making him an illegal alien subject to removal.

The current arrest detainer ensures that if the Collin County Jail were to release De Nova Duarte from local custody for any reason, ICE would be notified and take him into federal custody for processing and potential removal proceedings.
