ICE Nabs Serial Criminal Alien Sex Offender In Virginia Courthouse Sting

Immigration and Customs Enforcement (ICE) officers in Charlottesville on September 25 arrested a Mexican national with a long criminal history, including a recent conviction for sex crimes against a child.

The individual, David Ambrosio-Herrera, 36, was taken into custody immediately after leaving the Albemarle County Circuit Court, where he had been sentenced, according to ICE.

Ambrosio-Herrera was convicted of indecent liberties with a child under fifteen after exposing himself to a child at a school bus stop. Following his conviction, he was sentenced to six years in prison, all of which was suspended, and two years of supervised probation, as well as being ordered to register with the state sex offender registry.

ICE officers with the Washington D.C. Enforcement and Removal Operations (ERO) Harrisonburg suboffice arrested Ambrosio-Herrera in downtown Charlottesville after a brief foot pursuit when he attempted to flee. He remains in ICE custody pending his removal from the United States to Mexico.


History of Illegal Entry and Crime

Ambrosio-Herrera is described by ICE as a “serial criminal illegal alien.” He has illegally entered the country multiple times, which can be a felony.

“David Ambrosio Herrera is a serial criminal illegal alien and a convicted child sex offender. He is exactly the kind of person we aim to remove from the United States,” said ICE Washington, D.C. ERO acting Field Office Director Joseph Simon. “He has illegally reentered the country multiple times, has prior criminal convictions and should have never been here to traumatize this child.”

The individual’s history with U.S. immigration includes two apprehensions by U.S. Border Patrol in April 2007, both followed by voluntary returns to Mexico. He later illegally reentered the U.S. on an unknown date.

His criminal record in the U.S. includes a 2014 conviction in Charlottesville for identity theft: possessing a fictitious ID card, and 2017 charges in Albemarle County for perjury: falsely subscribing a written declaration. An immigration judge had previously ordered Ambrosio-Herrera removed from the United States in May 2024.

ICE Washington D.C. ERO stated it will “continue to prioritize public safety by arresting and removing criminal alien threats from our Washington D.C. and Virginia neighborhoods.”
