Leftists Follow Through On Trying To Unseat Republicans By Citing Obscure Constitutional Provision, “Insurrection” Hyperbole

Left-wingers are seeking to de-legitimize a Republican congressman for speaking at former President Donald Trump’s Jan. 6, 2021, rally.

As The Free Press reported on Wednesday, Democratic lawyer Marc Elias, a confidante of the Clintons, recently suggested radicals would sue to have Republicans kicked out of Congress or barred from re-election under an obscure constitutional provision dating to the Civil War. The idea is to cite the 14th Amendment’s provision outlawing those from serving who “shall have engaged in insurrection or rebellion” against the government. 

PJ Media reports that on Monday a lawsuit was filed in North Carolina to prohibit GOP Rep. Madison Cawthorn’s candidacy for re-election – citing a law used to block former Confederates from re-entering Congress in the wake of the Civil War.

“The suit, filed by 11 citizens and backed by the far-left groups Free Speech For People and the Bernie Sanders outfit Our Revolution, alleges that Cawthorn is ineligible because of Article Three of the Fourteenth Amendment, which states that a candidate is ineligible ‘who, having previously taken an oath, as a member of Congress … shall have engaged in insurrection or rebellion,” columnist Rick Moran noted.

“Who besides liberals in the media and on the internet has referred to the riot of Jan. 6 as an ‘insurrection’ or ‘rebellion’? These are legal terms with specific meaning and not political talking points to be bandied about by partisans,” Moran continued.

“The U.S. is not going to die from revolution. It will die of exaggeration and hyperbole.”

In its account of the lawsuit, the Associated Press noted that the Cawthorn haters contend his actions at the “Save America” rally “amounted to an insurrection.”

 They also claim that Cawthorn’s “comments and information in published reports provide a ‘reasonable suspicion or belief’” that he can be barred as an “insurrectionist.”

Yet the AP also pointed out that while Cawthorn voted against certifying Joe Biden’s win in the 2020 election – just as multiple Democrats did when Trump was elected in 2016, Cawthorn “condemned the Capitol violence” on Jan. 6 and “compared it to the summer 2020 protests over police brutality.”

As we know, the liberal media routinely reassured us that the George Floyd rioting and looting events were “mostly peaceful protests.”

Writing recently at TheHill.com, constitutional scholar Jonathan Turley noted that the Jan. 6 riot “has not been treated legally as an insurrection.”

“Those charged for their role in the attack that day are largely facing trespass and other less serious charges — rather than insurrection or sedition. That’s because this was a riot that was allowed to get out of control by grossly negligent preparations by Capitol Police and congressional officials. While the FBI launched a massive national investigation, it did not find evidence of an insurrection.”

The Constitution, Turley added, demands more than proof by “mantra-like” repetition.

“In this case, it requires an actual rebellion. The clause Democrats are citing was created in reference to a real Civil War in which over 750,000 people died in combat. The confederacy formed a government, an army, a currency, and carried out diplomatic missions,” he wrote.

“Conversely, Jan. 6 was a protest that became a riot.”

Turley concluded, “The renewed calls for disqualifications may be simply reckless rhetoric timed for the anniversary of the riot. After all, every day would not be Jan. 6 without the requisite rage. However, it is reason — not rage — that we need right now.”

“A recent poll showed that one in three Americans believes that violence against the government can be justified. It often seems like some want to trigger an actual rebellion by disenfranchising parts of our population. The fact is that there are people who traffic and profit in rage, and we are all the poorer for it.”
