‘No’ Turns Bloody: Florida Beach Relaxation Ends In Throat-Slashing Over A Cigarette

A relaxing afternoon by a lifeguard tower took a violent turn on a Florida beach when a man was slashed across the throat, allegedly for refusing to hand over a cigarette or his cellphone to a stranger.

Authorities have arrested 24-year-old Jack Daniel Gutierrez in connection with the brutal October attack on Miami Beach. He is currently being held without bond at the Turner Guilford Knight Correctional Center, facing a charge of aggravated battery with a weapon causing great bodily harm.

The incident unfolded on Oct. 23, 2025, near the 1700 block of Collins Avenue. According to arrest reports, the victim was sitting near a lifeguard tower when Gutierrez approached him.

The suspect asked for a cigarette, but the victim explained he didn’t smoke. Gutierrez then pivoted, asking to borrow the man’s phone. The victim declined that request as well.

Believing the interaction was over, the victim stayed seated. Police say that’s when Gutierrez struck, attacking the man with a blade. The victim reported feeling a sudden puncture and a “heavy volume of blood” pouring from his neck.

Despite a laceration that responding officers described as stretching “ear to ear,” the victim managed to activate Siri on his phone to call 911 hands-free. He was rushed to a local hospital for treatment and later identified Gutierrez in a photo lineup.

Gutierrez was taken into custody on Thursday. Court records indicate he was already on probation for a prior weapons charge at the time of the alleged assault. He is scheduled to appear in court Monday.
