‘Oh S—, It’s Not Working’: Florida Man Forgets Magazine In Alleged Murder Attempt

A Miami man remains held without bond after authorities say he tried to kill his wife through multiple methods on Friday night, at one point pulling the trigger of an unloaded gun.

Fael Francois, 67, faces charges of attempted murder, aggravated assault, and domestic violence battery following the incident at a home in the 1100 block of NW 114th Street.

According to the probable cause arrest affidavit, the victim was sleeping when Francois allegedly grabbed a pillow and attempted to smother her. After she managed to get out of bed, police say Francois grabbed her arms, shook her, and slapped her across the face multiple times.

The victim told investigators she broke free a second time and called her sister for help. At that point, Francois allegedly pointed a handgun at her head, stated “today, you are going to die,” and pulled the trigger.

The weapon failed to fire because there was no ammunition in the chamber and the magazine was not inserted. According to the police report, Francois then muttered, “Oh s—, it’s not working.”

The affidavit states that Francois then struck his wife with an unidentified object, cutting her left arm. The victim fled the house and hid behind a backyard shed to call 911.

Responding officers arrested Francois at the scene. During a subsequent police interview, he denied all allegations.

Francois, a Haitian national who works as a security guard, is currently booked at the Miami-Dade County Jail. Court records do not yet list a future appearance date.
