The Supreme Court on Monday cleared the way for the administration to proceed with an executive order regarding mail-in voting restrictions, granting an emergency request from the Justice Department ahead of the midterm elections.
The executive order, signed in March, directs federal agencies to compile lists of eligible voters and instructs the U.S. Postal Service to deliver mail ballots exclusively to individuals on those rosters. The Justice Department petitioned the high court to allow preparatory and implementation work to continue while litigation proceeds.
The ruling permits the administration to move forward, though the scope of immediate implementation remains uncertain.
With several states scheduled to begin distributing mail ballots in the coming weeks, the timeline for operational changes is constrained.
The decision does not conclude the underlying legal dispute and leaves open the possibility of additional court challenges. It is one of several voting-related cases currently moving through the federal judiciary.
President Donald Trump has cited concerns about potential election fraud as the primary rationale for restricting mail-in voting. State election records and voting studies indicate that instances of fraud associated with mail-in voting remain statistically rare. Trump has also utilized mail-in ballots in previous elections.
Federal agencies have not yet detailed how quickly the voter lists will be established or how the Postal Service will adjust delivery operations before voting begins.
