A federal judge on Friday for the U.S. District Court for the Eastern District of Virginia granted a preliminary injunction against Loudoun County Public Schools (LCPS), blocking the district from enforcing the suspension of a male student who objected to a biological girl’s presence in the boys’ locker room.
The order extends earlier emergency relief and ensures the student, represented by America First Legal (AFL) and the Founding Freedoms Law Center (FFLC), can continue attending school and receiving in-person education while the underlying litigation proceeds. Crucially, the injunction also prevents LCPS from placing a finding of Title IX sexual harassment on the student’s personal record.
The ruling follows an extensive hearing held on Friday, where the Court heard arguments in the case, S.W. et al. v. Loudoun County School Board. The lawsuit challenges LCPS’s decision to suspend two male students who were found guilty of Title IX “sexual harassment” for voicing objections to a girl being in the restricted male-only facility.

This preliminary injunction builds on a temporary restraining order issued in September that initially halted the punishment.
The suit alleges violations of the U.S. Constitution, the Virginia Constitution, Title IX, and the Virginia Religious Freedom Restoration Act.

Victoria Cobb, President of Founding Freedoms Law Center, echoed the sentiment, stating, “We’re pleased the Court sees the importance of halting a wrongful punishment so our client continues his education and both boys are ultimately vindicated.”
The case against LCPS will continue as the legal teams seek a permanent resolution for their clients. LCPS has not yet issued a public statement regarding the injunction.
