President Donald Trump signed an executive order on Monday, titled “Protecting American Communities from Criminal Aliens,” which aims to crack down on so-called “sanctuary jurisdictions” that limit cooperation with federal immigration authorities.
The order asserts federal supremacy in matters of immigration, national security, and foreign policy, citing constitutional provisions and inherent national sovereignty.
It criticizes the previous administration’s immigration policies and accuses some state and local officials of obstructing federal immigration law enforcement, labeling such actions a “lawless insurrection.”

Provisions of the executive order include:
- Designation of “Sanctuary” Jurisdictions: The Attorney General and the Secretary of Homeland Security are directed to publish a list of states and local jurisdictions that obstruct federal immigration law enforcement within 30 days. This list will be updated as necessary.
- Consequences for Sanctuary Status: Federal agencies are instructed to identify and potentially suspend or terminate federal funds, including grants and contracts, to designated sanctuary jurisdictions. The Attorney General and the Secretary of Homeland Security are also authorized to pursue legal remedies to ensure compliance with federal law.
- Preventing Federal Benefits for Aliens in Sanctuary Jurisdictions: The Secretary of Homeland Security, in coordination with the Attorney General, will develop guidelines to ensure proper eligibility verification for individuals receiving federal public benefits in sanctuary jurisdictions.
- Equal Treatment of Americans: The Attorney General, in consultation with the Secretary of Homeland Security, will identify and take action against state and local laws that favor aliens over American citizens, including those related to in-state tuition and criminal sentencing.
The order argues that some state and local policies violate federal laws related to obstruction of justice, harboring illegal aliens, and discrimination against American citizens.

The order’s implementation and potential legal challenges are expected to be closely monitored. The order states that it does not create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States.
