Florida Sen. Moody Scores Victory, Overturning Biden-Era “Green New Scam” Freezer Regulations

In an early victory, Senator Ashley Moody’s Congressional Review Act (CRA) to dismantle what she calls the Biden-Harris administration’s “Green New Scam” regulations on commercial refrigerators and freezers has passed the U.S. Senate.

The legislation, which targets energy conservation standards imposed by the Department of Energy (DOE), is now headed to the President’s desk for final approval.

Moody, marking her first major legislative success just after her 100th day in office, characterized the regulations as “irresponsible and illogical overregulation” that would have imposed undue financial burdens on businesses and families nationwide.

“The Biden-Harris administration attempted to force costly and burdensome regulations onto the American people and their businesses in an effort to advance their Green New Scam agenda,” Senator Moody stated. “I am proud to take this fight head on to ensure that small businesses and American families are not shouldering the cost of the last administration’s nonsensical regulatory state. Thank you to my colleagues in the House and Senate for their support. I look forward to this legislation heading to the president’s desk to become law.”

The regulations in question, which set stringent performance standards for commercial coolers and freezers, were criticized by industry stakeholders for their potential to drive up costs. The North American Association of Food Equipment Manufacturers (NAFEM) voiced strong opposition, citing the DOE’s own analysis that revealed the exorbitant payback periods for the mandated energy-efficiency upgrades.

“As DOE acknowledges in its own analysis, the increased capital expense costs caused by these standards may take customers more than 10, 75, and up to 93.9 years in many instances to match cost reductions achieved through energy-efficiency gains,” NAFEM stated. “More expensive equipment translates into higher costs for consumers. This is simple economics. As the cost of inputs and doing business increases, a restaurant’s or grocer’s prices also must increase to make enough of a profit to stay in business.”

The House of Representatives previously passed the CRA, and Senator Moody introduced the Senate resolution to formally disapprove of the DOE’s “Energy Conservation Program: Energy Conservation Standards for Commercial Refrigerators, Freezers, and Refrigerator-Freezers.”

The Senate passed the CRA by a vote of 52-45. With its passage, the legislation now moves to President Trump’s desk, where it is expected to be signed into law, effectively nullifying the Biden-era regulations.
