Deported 6 Times, Man Arrested In Massachusetts On Unlawful Reentry Charge

An illegal immigrant has been charged with unlawfully reentering the United States after previously being deported. Carlos Guaico-Bano, 35, an Ecuadorian national residing in Lawrence, Massachusetts, was arrested Friday morning.

According to court documents, Guaico-Bano had multiple encounters with Border Patrol agents in Texas in early 2020. Records indicate encounters in Brackettville, Eagle Pass, and El Paso on February 4, February 10, February 19, and March 3, 2020. In each instance, agents determined he had no lawful right to be in the U.S. and returned him to Mexico.

During the March 3, 2020, encounter, Guaico-Bano was served with a Notice to Appear for removal proceedings scheduled for March 10.

However, he allegedly failed to appear and instead attempted to enter the U.S. again without permission, being apprehended on the same day. He was taken into custody and processed for removal, and an immigration judge in San Antonio, Texas, ordered his removal to Ecuador on March 10, 2020.

Court records further state that Guaico-Bano was caught attempting to enter the U.S. illegally for a sixth time in September 2020 and was again removed to Ecuador.

Immigration authorities became aware that Guaico-Bano had reentered the United States on November 23, 2021, following his arrest in Lawrence on November 17, 2021.

He was subsequently charged and convicted of one count of Assault and Battery and one count of Assault and Battery with a Dangerous Weapon in connection with the Lawrence arrest. He received an 18-month suspended sentence and was released from custody before Immigration and Customs Enforcement could take action.

The charge of unlawful reentry of a deported alien carries a potential sentence of up to two years in prison, followed by one year of supervised release and a fine of up to $250,000. Following the completion of any sentence imposed, the defendant is subject to deportation. Sentences are determined by a federal district court judge based on the U.S. Sentencing Guidelines and applicable statutes.
