A contentious debate is brewing within the Republican party as some members of Congress reportedly consider rolling back a key provision of the 2017 tax cuts, a move that would significantly impact small and medium-sized businesses across the nation.
This potential shift comes as lawmakers grapple with the impending expiration of those broad tax reforms and explore ways to address the federal budget.
The Pass-Through Entity Tax (PTET) deduction is at the heart of the discussion, a policy implemented following the 2017 tax plan. This deduction was designed to prevent the double taxation of businesses structured as S corporations, LLCs, partnerships, or sole proprietorships.

These “pass-through” entities typically pay state income taxes on their earnings, and the PTET allows them to deduct these state and local taxes when filing their federal returns.
Without this provision, these businesses would face federal taxation on income already taxed at the state level – a situation that large, publicly traded corporations avoid.
Advocates for maintaining the PTET argue that it levels the playing field for Main Street businesses, which constitute over 90% of all American companies and employ more than 65 million people.
They contend that these businesses, ranging from family-owned shops to local manufacturers, are the backbone of American economic vitality and have already navigated a challenging economic landscape. Eliminating the PTET, they warn, would disproportionately burden these enterprises, potentially hindering their growth and competitiveness.

Critics of a potential repeal emphasize that the primary challenge facing the federal budget is excessive spending, not insufficient revenue.
They argue that targeting a successful element of the previous administration’s economic agenda to offset budget concerns would be a misguided approach. Furthermore, it’s suggested that such a move could have significant political ramifications, handing Democrats a powerful narrative of Republicans raising taxes on small business owners.
The debate over the PTET highlights a potential divide within the GOP as they navigate complex fiscal decisions. The outcome of these discussions in the coming months will have significant implications for Main Street businesses and the broader American economy.
