Florida boaters are charting a new course of freedom on the state’s picturesque waters, thanks to Governor Ron DeSantis. Today, the Governor proudly signed Senate Bill 1388, aptly dubbed the “Boater Freedom Act,” into law, signaling a significant shift towards less government intervention and more open seas for recreational enthusiasts.
“Florida is the boating and fishing capital of the world—and the Boater Freedom Act will ensure that this remains the case,” declared Governor DeSantis, emphasizing the state’s commitment to its vibrant marine culture.

The newly enacted legislation is a direct response to concerns about overreach by local entities and aims to protect boaters’ rights while maintaining crucial environmental safeguards. A cornerstone of the Boater Freedom Act is its prohibition on local bans of gas-powered vessels, ensuring that boaters who prefer traditional fuel will not face restrictions from “activist local entities.”
Perhaps one of the most celebrated provisions of the bill is the elimination of random vessel safety inspections. Previously conducted as “safety compliance” checks, these inspections will now require probable cause, striking a balance between ensuring adherence to boating laws and reducing unnecessary disruptions for law-abiding boaters. This move is expected to make enforcement more practical and effective, fostering a greater sense of trust between boaters and law enforcement.
Further streamlining the boating experience, the Boater Freedom Act directs the Florida Fish and Wildlife Conservation Commission (FWC) to collaborate with tax collectors to proactively issue a “Florida Freedom Boater” decal at the time of vessel registration. This decal will serve as a clear indicator to law enforcement that the boater has already met proper safety requirements, further reducing the need for roadside or on-water stops. This innovative program will be linked to a five-year safety inspection decal, promoting long-term compliance.

This landmark bill is the culmination of the Governor’s “boater freedom initiative proposal,” initially announced in February of this year, demonstrating a clear commitment to empowering Florida’s boating community.
In a move to further enhance access and enjoyment, Governor DeSantis also signed House Bill 735. This accompanying legislation provides additional funding for public boat ramps, parking facilities, and marina programs through the FWC. These crucial funds are designed to ensure greater public access to Florida’s abundant waterways, reinforcing the state’s reputation as a premier destination for boating and fishing enthusiasts.
With the signing of the Boater Freedom Act and increased funding for access, Florida is firmly cementing its position as the ultimate destination for those who cherish the open water, promising a future where freedom and enjoyment are paramount for every boater.
