Senator Ashley Moody (R-FL) introduced the “Expedited Removal of Criminal Aliens Act” on Wednesday. This legislation would amend the Immigration and Nationality Act to allow for the swift deportation of certain criminal non-citizens.
The bill, co-sponsored by Senator Eric Schmitt (R-MO), is presented as a critical measure to support President Donald Trump’s immigration priorities and counteract what proponents describe as the Biden administration’s “disastrous border policies.”
Moody asserted that the legislation is a direct response to a perceived “systematic dismantlement” of the country’s immigration and national security structure under the current administration.

“The American people gave President Trump a mandate to clean up Biden’s mess. Democrats and lower-level, partisan judges, however, have sought to block his efforts at every turn,” Moody said.
She specifically cited instances where, she claims, efforts to remove dangerous individuals, including MS-13 gang members and those convicted of heinous crimes, have been obstructed.
“Democrats have fought against the quick removal of illegal aliens who have committed atrocious crimes against children or even those that have been convicted of murder. It makes no sense,” Moody said. “Today we are finally putting common sense immigration policies first by introducing legislation to authorize the expedited removal of dangerous criminals and prevent activist-judges from keeping known terrorists, criminals and gang members on American soil and endangering our communities.”
Schmitt agreed, emphasizing that undocumented immigrants who have broken the law “are not due the same process as American citizens.” He added, “The Supreme Court and the Constitution agree, and it’s time we expand the expedited removal process to allow the President to secure our great nation.”

The “Expedited Removal of Criminal Aliens Act” specifically authorizes expedited removal for an alien who:
- Is a member of a criminal gang or organization;
- Is a member of a foreign terrorist organization or has provided material support to such an organization;
- Has been convicted of any felony, any misdemeanor against a member of a vulnerable group, any assault of a law enforcement officer, any sexual offense, any crime of domestic violence, any stalking offense, any crime against children, including sex trafficking of a minor or sexual abuse of a minor, any activity relating to material involving the sexual exploitation of minors, or any violation of a protection order.
Moody’s office highlighted her past efforts as Florida’s Attorney General to challenge the Biden administration’s immigration policies. This included multiple visits to the U.S. Southwest Border and numerous legal actions, many of which, her office states, were successful.

Notably, in 2023, a federal judge reportedly sided with then-Attorney General Moody, ruling that the Biden administration was responsible for the border crisis and had effectively turned the U.S. Southwest Border into “little more than a speedbump.”
As part of that litigation, Moody’s office deposed the sitting Border Patrol Chief and, her office claims, uncovered “mountains of damning evidence.” The judge subsequently ordered Biden’s “catch-and-release” policy unlawful, though Moody’s office asserts the Biden administration repeatedly attempted to circumvent the ruling
