DAVENPORT, Fla. – A Davenport man is facing second-degree murder charges following a domestic dispute that escalated to a fatal shooting on Wednesday evening. Kelly Agar Garcia, 43, is accused of shooting and killing his 26-year-old step-son, Azareel J. Martinez.
According to police reports, officers responded to a residence on Citrus Landing Blvd at approximately 7:10 p.m. on Wednesday, May 21st, following reports of a shooting. Investigators determined that the incident began with a disagreement over a video game.
Police say Adriane Daza, 48, discovered her 9-year-old son playing “Fortnite,” a game previously forbidden by the parents, in his adult brother Azareel Martinez’s upstairs bedroom. When Daza attempted to discipline the child by taking away his cell phone, the 9-year-old became upset.

As Daza and her son walked into her bedroom, the 9-year-old reportedly retrieved a Smith & Wesson 9mm handgun from a nightstand drawer. Garcia, the boy’s stepfather, and Daza struggled with the child for control of the weapon, with Garcia ultimately securing it.
At that point, Martinez entered the bedroom and saw the 9-year-old and Garcia holding the firearm. A verbal altercation then erupted between Martinez and Garcia. During this confrontation, Garcia allegedly shot Martinez multiple times in the chest and abdominal area.

Authorities report that Martinez retreated from the bedroom, with Garcia following him. Garcia then allegedly shot Martinez twice more in the back before he collapsed.
Martinez was transported to a local hospital, where he later died from his injuries.
Following an investigation, Kelly Agar Garcia was arrested and charged with Second Degree Murder and Unlawful Storage of a Firearm (Accessible to Minor). He is currently being held in the Polk County Jail.
