A jury in Georgia found Gregory Davis Jr., 27, guilty of causing the fatal injuries to a 1-year-old boy in his care in 2021. The verdict was announced on May 1, 2025, following a trial in the Cherokee County Superior Court.
Davis was convicted of malice murder, felony murder, first-degree cruelty to children, and willful obstruction of law enforcement officers in connection with the death of James “Jamie” Marco Palcio. Sentencing will be scheduled at a later date.

According to the Cherokee County District Attorney’s Office, the case stemmed from an incident on April 28, 2021. The Cherokee County Sheriff’s Office responded to a report of an unresponsive baby at a residence. At the time, the victim’s mother was at work, and Davis was the only adult supervising the child.
Prosecutors presented evidence that pediatric specialists who examined the infant determined he had sustained “abusive head trauma consistent with shaking.” The extensive injuries included subdural hemorrhage, retinal hemorrhages, ligamentous injuries to the neck, a fractured rib, and fractured vertebrae in the lumbar spine.

Tragically, Jamie Palcio was pronounced brain dead two days later, on April 30, 2021. An autopsy subsequently revealed the cause of death to be acute and healing traumatic injuries to the head, neck, and torso, and the death was ruled a homicide.
The conviction follows an investigation into the circumstances surrounding the child’s death and the injuries he sustained while in Davis’s care.
The victim’s mother was also reportedly charged in connection with the case at an earlier stage.
Davis remains in custody awaiting his sentencing hearing. The date for that proceeding has not yet been set.
