Jonathan Turley: Judges Undermining Their Own Anti-Trump Rulings

George Washington University law professor Jonathan Turley stated on Tuesday that federal judges who are blocking President Donald Trump’s policies may be providing grounds for their decisions to be overturned on appeal.

Speaking on “Fox and Friends,” Turley highlighted concerns that comments made by some judges during hearings could “undermine” the credibility of their rulings.

He cited an example involving Judge Breyer’s comments during a hearing related to the National Guard, where Breyer allegedly compared Trump to King George III. Turley suggested such remarks, along with opinions echoing “political talking points,” could weaken the courts’ standing.

“In some cases, these judges are undermining their decisions,” Turley commented. “Go back to the National Guard decision with Judge Breyer. You know, in the hearing right before the ‘No Kings’ protest, he referred to Trump as behaving like King George [III], and he said that and he ended up in the opinion, almost echoing some political talking points, saying that the president is creating essentially disorder by trying to bring order through the Guardsmen.”

Turley’s comments come as federal district courts have issued numerous nationwide injunctions against various Trump administration policies, from immigration enforcement to funding decisions.

The Supreme Court recently held a special oral argument session on May 15, specifically addressing the practice of nationwide injunctions in relation to a Trump executive order on birthright citizenship.

The backdrop to these legal debates includes recent events where President Trump ordered 700 Marines to support federalized National Guard troops after riots erupted in a city following Immigration and Customs Enforcement (ICE) raids.

Some Democrats have called for ICE to halt operations in the Los Angeles area to “restore order.” The FBI has also offered a $50,000 reward for information leading to the arrest of an individual identified as Elpido Reyna, who was seen throwing rocks at federal law enforcement vehicles.
