Supreme Court Allows Trump Admin To Revoke Venezuelan Immigrant Protections

The Supreme Court on Monday granted the Trump administration’s emergency application to revoke special legal protections for thousands of Venezuelan immigrants.

The decision allows the administration to proceed with dismantling a Biden-era policy that extended Temporary Protected Status (TPS) to over 300,000 Venezuelans.

The high court’s order signals that the legal battle will now continue in lower courts. Justice Ketanji Brown Jackson noted her dissent, indicating she would have denied the administration’s application.

The core of the dispute revolves around the TPS program, established in 1990 to offer humanitarian relief to individuals from countries facing war, natural disasters, or other crises.

In March 2021, the Biden administration designated Venezuelans as eligible for TPS due to the political instability plaguing their home country. This designation allowed approved individuals to reside and work legally in the United States for up to 18 months, with the possibility of extensions.

The current legal challenge stems from a subsequent designation made in October 2023, which was extended in January just before Trump took office, setting an expiration date of October 2026. However, Homeland Security Secretary Kristi Noem, in February, sought to reverse these designations, aiming to terminate the protections earlier this year.

A judge in the Northern District of California blocked Noem’s move, citing concerns that the decision was influenced by racial animus. The Trump administration then appealed the ruling, leading to the Supreme Court’s intervention.

The Supreme Court’s decision to grant the stay allows the Trump administration to move forward with its plan to revoke the TPS designation.
