A startling memorandum issued by President Donald J. Trump to U.S. Attorney General Pam Bondi calls for an investigation into alleged abuses of power during the Biden administration.
The document, titled “Reviewing Certain Presidential Actions,” outlines claims that former President Joe Biden’s aides orchestrated a deliberate effort to conceal his purported “serious cognitive decline” by using an autopen to sign critical official documents.
The memo asserts that the American public was “purposefully shielded” from the truth about who was genuinely exercising executive authority.

It claims that “former President Biden’s aides abused the power of Presidential signatures through the use of an autopen to conceal Biden’s cognitive decline and assert Article II authority,” even as his signature was “deployed across thousands of documents to effect radical policy shifts.”
Among the document’s more dramatic allegations, it references a Department of Justice conclusion suggesting Biden should not face trial for alleged law-breaking due to an “incompetent mental state.” It further claims that Biden’s cognitive challenges were “worse” in private, with advisors reportedly attempting to “hide it” by tightly controlling his public appearances and scripting his conversations.
Despite these alleged issues, the memo highlights the significant volume of official actions taken during the Biden presidency: over 1,200 Presidential documents issued, 235 judges appointed, and a record number of pardons and commutations.

This includes, controversially, the commutation of sentences for 37 death row inmates just before Christmas in 2024. The memorandum questions the legitimacy of these actions, asking if Biden was even “aware of these actions being taken in his name.”
At the heart of the memorandum’s claims is the alleged widespread use of an autopen for “the vast majority of Biden’s executive actions,” particularly in the latter half of his presidency when, according to the memo, cognitive decline became “even more clear.” The document warns that if advisors secretly used an autopen to mask incapacity while executing “radical executive actions,” it would constitute an “unconstitutional wielding of the power of the Presidency,” potentially invalidating numerous official acts.
The memorandum explicitly directs the Counsel to the President, in consultation with Attorney General Bondi, to launch an investigation into whether individuals “conspired to deceive the public about Biden’s mental state and unconstitutionally exercise the authorities and responsibilities of the President.”

This broad inquiry is tasked with examining:
- Any coordinated activity to conceal information regarding Biden’s mental and physical health.
- Agreements among Biden’s aides to falsely dismiss recorded videos of his cognitive struggles as fake.
- Agreements to mandate false public statements exaggerating the President’s capabilities.
- The overall purpose of these activities, including the assertion of presidential authorities.
Furthermore, the investigation is to meticulously scrutinize “the circumstances surrounding Biden’s supposed execution of numerous executive actions,” pinpointing which policy documents were autopen-signed and, crucially, “who directed that the President’s signature be affixed.”
