Florida AG Moody Successful On 11th-Hour Attempt To Prevent Biden’s Mass Release Of Illegal Migrants

Florida Republican Attorney General Ashley Moody on Thursday made a last-ditch attempt to protect the Sunshine State from the consequences of President Joe Biden’s open-borders policy.  

Siding with arguments by Moody, a federal judge late Thursday issued a temporary restraining order against a new Biden administration policy that would lead to large numbers of migrants being released into the United States.

In his ruling, Pensacola-based U.S. District Judge T. Kent Wetherell wrote that the “challenged policy appears to be materially indistinguishable” from an earlier Biden administration policy that he ruled in March violated federal law. The earlier policy was known as “Parole Plus Alternatives to Detention,” or “Parole+ATD.”

Title 42, the federal law that allows the federal government to expel illegal immigrants without a hearing because of a public health emergency, expired on Thursday. The expectation, even from the Biden administration, is an onslaught of illegal streaming across the Mexican border.

Moody, in response, sued the administration in federal court. She asked a judge to slap a temporary restraining order on President Joe Biden’s policy to parole illegal immigrants captured at the border into the country, in violation of a March court order.

“The Biden Administration’s behavior, if left unchecked, makes a mockery of our system of justice and our Constitution,” Moody argued in court records.

Moody said that because of Biden’s “mismanagement” of the border, more than 1 million illegals have already crossed into America. More than 100,000 of them have ended up in Florida.

“Under the new parole policy announced by DHS [Department of Homeland Security], tens of thousands more will be released and will likely make their way to Florida,” Moody said. “Florida will continue to expend funds on illegal aliens present in the State in the form of public education, incarceration costs for aliens who commit crimes, unemployment benefits, and emergency Medicaid. Those costs will increase as a result of the new parole policy.”

In short, she added, Florida will be “irreparably harmed” by Biden’s open-borders policy.

Moody maintained Biden’s newest policy is illegal for three reasons:

First, the policy contains no mechanism to ensure illegals can be returned to custody if their parole is negated. Biden plans to releases thousands at once when the law says they should be adjudicated “case by case.” Finally, the law states that parole should be granted for “urgent humanitarian reasons or significant public benefit,” yet Biden plans to release illegals solely to relieve overcrowding at detention facilities.

Ultimately, Moody added, Biden’s policy lacks specifics and purpose, and thus is an “arbitrary and capricious” attempt to circumvent the court’s earlier ruling blocking the release of illegals.
