A Florida man was arrested on Wednesday and charged with sexual battery after an investigation revealed he had sex with a woman who lacked the mental capacity to legally consent, according to deputies.
According to investigators, Christopher Alan Phillips, 36, of Zolfo Springs, picked up the victim in his vehicle on a Sebring road in October of 2021 and took her to a wooded area, where they had sex.
The victim, who is an adult, was examined by a specialist who determined she meets the statutory definition of someone who is not able to legally give consent.

The victim has the mental capacity of someone who is around 10-12 years old.
Phillips’ was booked into the Highlands County Jail on a bond of $100,000.
