Florida Rep. Matt Gaetz sent a request to the Department of Justice (DOJ) Inspector General Michael Horowitz Wednesday to investigate Special Counsel Jack Smith for election interference against President Donald J. Trump.

According to Gaetz’s office, Special Counsel Smith’s actions to expedite the Trump case have no other purpose than to ensure a trial before the November 2024 election, in violation of DOJ rules and federal law, and he has admitted as much in his briefs before the Supreme Court.

“The witch hunt against President Trump by Attorney General Garland and Special Counsel Smith is a partisan exercise, and the American people know it. The actions of the Special Counsel Smith to speed up the trial against President Trump violate the DOJ’s rules and the law. His public comments and his office’s briefs before the Supreme Court demonstrate that he has no reason for his actions other than to unlawfully interfere in the 2024 presidential election,” said Gaetz in his letter.

Jack Smith, the Justice Department special counsel, has proposed a start date of July 8 for former President Donald Trump’s document case.

However, Trump’s lawyers also argue that a fair trial cannot be conducted until after the 2024 Presidential election.

Trump is facing 41 charges related to the keeping and hiding of classified documents. These documents, with classified markings, were discovered at his Mar-a-Lago estate more than a year after he left the White House.

Among the recovered documents were those containing information about defense and weapons capabilities, United States nuclear programs, and potential vulnerabilities of the United States and its allies to military attacks.

Trump contends that he designated the documents as personal before leaving the White House, suggesting that they should fall under the Presidential Records Act and be handled as civil disputes rather than criminal charges.

The Supreme Court’s decision to hear Trump’s immunity argument in another federal criminal case could also impact the trial, as Judge Aileen Cannon may await a ruling from the high court.
