The Justice Department’s special counsel investigating President Joe Biden for mishandling classified documents insisted that Biden should not be charged with breaking federal law because he is an “elderly man with a poor memory” — so poor in fact that he lacks “willfulness” to actually break the law.

In response, Rep. Marjorie Taylor Greene argued that Biden’s fading memory is a national security risk, and that the American people are left with two options: remove Biden from office through impeachment or invoking the 25th Amendment.

Under the 25th Amendment, the president is removed, and the vice president takes over as president if a majority of the Cabinet and a two-thirds supermajority of Congress agree that the president is no longer physically or mentally fit for office.

“I think we’re in a national security crisis,” the Georgia Republican told Fox News after Special Counsel Robery Hur’s report came out.

“If Joe Biden is not fit to serve trial, then he is not fit to serve as president of the United States,” Greene added.

Greene noted that Biden is accompanied by the “nuclear football,” which holds the launch mechanism for America’s nuclear arsenal.

“He is making the biggest decisions on behalf of our entire country — not only our country, but the entire world. Yet he’s not able to stand trial for all the [classified] documents he kept. … This is extremely serious,” Greene said.

Greene said she would discuss options with House Speaker Mike Johnson, but in reality there are only two.

“We need to look at possibly impeachment. But the Cabinet should be invoking the 25th Amendment,” she said.

Per the special counsel’s report, Biden in an interview could not recall when he served as vice president (2009 to 2017) and could not recall when his son Beau died, even though Biden has repeatedly brought up his son’s death for political points, including last week when he spoke to the family of one of three U.S. troops killed in Jordan by a militants’ attack.

During a hastily called press conference Thursday night to address Hur’s report, Biden referred to Egyptian President Abdel Fattah al-Sisi as the president of Mexico.

Greene said House Republicans “absolutely have to” look into Hur’s findings and their implications.

“This cannot be dismissed,” she said. “His mental clarity, his memory, his ability to make decisions ios extremely important as president of the United States, and the Democrat Party cannot hide this anymore. We have to move forward and do something about it.”

On X, Greene added, “Joe Biden is unfit to serve as POTUS! Two solutions: 25th Amendment or impeachment.”
